The first group is from January of this year. Josh starts out by requesting to meet with Scott and wants to state the fact that he wants at least the same staffing levels of the 2006-2007 budget. He also brings up a “New Commissioner Orientation”. Scott follows up with bringing up the subject of “Performance Based Budgeting” and funding for the County. The other emails continue discussing these 2 issues.
Next set is from Jan. 25th. Apparently there was a Department Head meeting and the Performance Budgeting was brought up again. The first and second email is from Josh and he copies an email sent to him by Deb Kraske. She brings up using the DACMS database for calculating if Josh really needed the 2 staff positions.The positions that were approved and hired 2 weeks after the 3rd Judge started.
Josh continues with his email following “Astoria Or, 97103”.
At the end of Feb there is a small amount of email activity where Josh is attempting to set up a meeting with Scott and they seem to have some trouble finding a good time.
During the first week of April the Budget is starting to become finalized and Josh starts off saying he is pleased with what has transcribed so far. The next email is apparently after Josh viewed the Budget and had a question or two.

In the next set Scott send the first message, but it is repeated in Josh’s response, so I only included that one.
Context to this set is that Scott was using the data from the database to make the case that maybe Josh didn’t need the 2 positions. Many of those documents were posted on NCO in early may.
Josh then made up his own presentation as he mentions at the bottom of the last email.
The last email set is where things start to get a little more testy. Many of these emails also did not have dates, so I put them together the best I could. The first is from May 10th, and the Budget Committee meeting is only 5 days away. Both Scott and Josh are putting their best info together to try and prove their case to the Board. The second email, where Josh mentions China and documents posted on NCO, did not have a date. I can only guess it was Friday May 18th, the day Jeff mentions China on his blog. Scott’s short response about having no more info regarding the D.A. budget is also without a date.
The next one that Josh writes from China says a date of June 5th, but I am certain it was a few days before that.
And finally, if you have made it this far, is the full email from Jeff. He wrote this after reading all of the previous emails. Josh’s response is below.

Josh, I have become dismayed at your tyrannical attacks on our county manager. I am also deeply offended that you suggest that I couldn’t have come up with the idea of cutting the stipend of the district attorney by myself.
I absolutely was the one that came up with it and as I explained at the budget committee meeting and in talking to the news media who contacted me, I have long felt that it is not the place for a county to supplement the pay of a state employee. The state is responsible for paying the district attorneys throughout the state a wage that is deserving of the work that they do. I have not, do not, and will not support the counties backfilling the wages of the district attorneys or any other state employee. Believe it or not, Josh, I am a man that can think for himself and am not under the influence of anyone. I am not a whipping boy out to do someone’s dirty work.
Your style of emailing can only be described as juvenile and abusive by me. Your use of phrases such as “sunshine is a great disinfectant” and “be a man Scott” along with your capitalization of words throughout the emails you send are frankly beneath a person of your intellect and stature as an elected official. Your reminder of the Rotary Four-Way Test is an affront to the beliefs that the founders of the Rotary organization had.
You may not “demand” a copy of the agenda for a meeting. The agenda has not been finalized and you will be provided one when it is.
It is clear to me that you cannot communicate in a civil manner. I am going to suggest that it will be more productive to have your communications directed to the entire board of commissioners rather than any staff members. As elected officials we can more effectively address concerns that you have. Your emails have increasingly become harassing in nature and I will not stand by and allow our staff to have to tolerate it. Anything less would be enabling your behavior.

Jeff – I had to beg you for weeks for a meeting about my budget. If this was indeed something you had thought about why not mention it at our meeting? If you were so concerned about this issue why didn’t you speak to Sen. Johnson or Reps Boone or Witt? Or just ask me about the years I have been working with AOC to increase state funding?
I am sure you are very capable of thinking for yourself but I’ve been in politics a lot longer than you and I know an ambush when I see it. Scott is the Budget Officer and CEO yet he has NO advice about such an important matter? I find that hard to believe. Scott even procured a legal opinion – which he furnished you a week before the May 11 meeting – from 2005 that specifically said the Budget Committee had no authority over my stipend.That was not the venue and to say I was taken by surprise was an understatement. I recognize that the Commission, not the County Manager makes final decisions about the budget and any decision about the stipend I was paid for 12 years.
I don’t know if you are a Rotarian but I am and as one (and Scott is too) I would have expected Scott to say something if there had been any way in which my budget had not been properly prepared or if the performance measures I set out (and were ignored) were in some way inadequate. That would be fair. That would be the right thing. That would build good will and friendships. That would be beneficial to all concerned
You told my wife you don’t remember my chief deputy telling the committee about how a criminal tried to murder his family but perhaps you do remember Ann Samuelson during our meeting in early May in my office saying that we/I would need at least a couple of years to establish benchmarks for any performance measures.
You have been consistent in saying this was for principle but Richard Lee said it was because I didn’t co-operate in the budgeting process and Patricia Roberts said “it was to get my attention.” Actions have consequences and if you stab me in the back do not not expect me to meekly accept it. I admire people who just stand up and say what they think. Perhaps you are that sort of person.
I am and will continue to be a county department manager whether I am compensated or not. I need to communicate with the County Manager but given the difference in recollections I have found it best for it to be writing. I know you hold Scott in the highest esteem and he clearly shares everything I send him with you. All my e-mails are public record. I am unaware of any “tyrannical attacks.” My tone is sharp because I don’t get straight answers.
We have a County Manager form of government and he is the CEO. I would be perfectly happy to have all our e-mail communications posted or made public. I am also sure he is capable of speaking for himself. He’s a very smart guy.
I have tried to make myself available 24/7 to answer questions and neither you nor most of the other commissioners have thought it was necessary.
I take great pride in my work and that of my incredible staff and the important work we do and I will continue to advocate for them.
I look forward to a frank discussion of the budget issue on June 13 and hope the Commission will allow all who wish to speak to do so.

Tryan can tell you where he got these e-mails and how quickly they were made available to him. They speak for themselves. Scour the e-mails and find a single request that I perform some act that I failed to fulfill.

It has been designated a High Intensity Drug Trafficking Area so it, too, has special needs and circumstances making it have higher than normal court cases. In Jackson Co. there is 1 deputy DA per 12,000 people, about the same as ours BEFORE the additional staff that the District Attorney has insisted is needed. The Jackson Co. DA tells where the funding comes from for each of his programs. He tells what grants were obtained and which ones could be gone for to increase revenue. HE WORKS WITH the budget committee and county manager, or at least does a damn good job of appearing to do so!
The Clatsop Co District Attorney keeps harping that a study that was commissioned by the county says his office should have 7 deputy district attorneys and now that is what he wants. It is a completed study which we paid $10,000 for so we better follow it or we’ve lost its input, or it value if not followed? We paid for its input. The information is used along with other information gathered. Whether or not its recommendations are followed would be the same as saying that the county commissioners MUST accept ALL of the budget committees recommendations or their time and effort (worth considerably more than $10,000 since that is only $1000/person or less than $10/hour for the time put into reviewing and meetings) is wasted! Is that realistic? I don’t think Marquis thinks it is or he wouldn’t have begged all of his colleagues and friends to write letters attacking our commissioners to his stipend back.
While Jeff Hazen had his reason for proposing that the stipend of state employee be cut, every person on the budget committee had their own reason for agreeing to his recommendation as well, every commissioner has their own reason for agreeing. While many or most may have initially agreed with Hazen’s reason by now a few will have a multitude of reasons for staying resolutely firm with the decision to strip the stipend.
You don’t serve at my pleasure. It would be my pleasure if your party actually had confidence in you and allowed someone to run against you. As it is no one has any desire to be your chew toy, and I do mean no one, and that is the only reason you happen to be serving at this moment. Take care. One person indicate that they are willing to take your place and its good-bye, so long. Luke Rummell and Bastiani well not be able to run a very effective campaign. And while wifey may be a great promoter begging for your op-ed pieces to run in the Times, her nasty comments on the blogs will be used when you run again.
Aw, ever the lawyer and politician. Many want to hear that they live in a democracy and that are run by a democratic process and that’s what you tell them! You forget to inform fully. We live in republic not a democracy. Your not very democratic about how you run your office or how you handle cases or how you come up with evidence. I guess your more “republic” about that?

The people that I know were frightened to appear but hopefully got their letter in so their voice is still there as to Marquis’ trumping up charges out of nothing cases to stack the courts causing problems for the judges just so he can have a large staff doing his job. We are a county of 36,000 people yet we have the DA office staff the size of Benton Co’s with a population of 80,000 with a comparable budget as well!
Pat Burgess with the Clatsop County Resource center spoke about everything that has come about for women since Josh Marquis took office. I have so many questions about that. First off, why wasn’t that a part of his presentation to the budget committee? Why would that be so damn hard? Second, how much of those wonderful things were the norm that all DAs were instigating in their counties? For god’s sake, the man had been running for a DA presidential position in one association or another for the past decade, he has to show a reason to vote for him. He has to have programs that are working. Its nice to be a county thats benefiting from the gadfly but at what COST? I mean that both economically, physically and psychologically.
Yes, I am personally angry with him. I haven’t had the experience these victim’s had when Marquis helped them. In 1996 when my sister, in a drunken rage beat my mother and left massive bruises on her body, our family had hit the wall. Debbie had gone in and out of five rehabs, leaving against medical advice, three times taking my parents cash balances with her. She was 34 years old and had three children. She was living in Warrenton and had turned to prostitution to keep her drug habit going. She was sleeping with Ricky Sutton with children in the bed. Fifty relatives wrote to the court and the DA’s office to keep the children in the custody of the CSD and placed with me and my husband where they had lived for eight months. Josh Marquis suddenly showed at the hearing to represent the state. One of his deputies had represented the state prior to that. He said he was there because he wanted to make sure the children were returned to the mother as she was trying to turn her life around and he wanted to make sure that the cult my family belonged to and that my sister had escaped from didn’t get her children! WHAT? My family didn’t even all belong to the same religion much less a cult! Fifty people from several different religions or no religions had written letters describing Debbie’s behavior and the fear they had for her children. And Josh Marquis said those letters meant nothing as they were emotional letters of people without proper training to make determinations.
Yet he asks people to write on his behalf. Whether or not they have the proper training to make determinations.
Judge Nelson told Marquis he didn’t want to hear anything more about cults, none of the religions of the people involved qualify. Marquis was shocked and kept trying to bring up people’s religion, which most of us ignored. Judge Nelson ordered the children to remain in the care of Children Services and strongly recommended they remain in the home of their aunt and uncle where they had been for the past eight months. Josh Marquis had point blank told the judge that the mother had escaped from a cult that the family belonged to and wanted to rescue her children from it and he was there to help her get them back. He ignored the fifty letters from family and friends. He never looked at any facts. He never looked at the psychiatric report on my sister. He wanted the sensationalism of rescuing kids from a cult. When people speak of Marquis caring about kids I think of my nieces and nephew and know it as a lie.
Two hours after the court case the caseworker met with the family and said, “You may have thought you won something but you won nothing. A judge can only make recommendations to this office and you’ve just lost these kids by going up against the state. I’ll have them back with their mother within 30 days and don’t bother going to the DA or anyone else now you burned that bridge, no one’s listening to you.” WHAT? We didn’t even know the guy. How is it our fault we didn’t belong to a cult and he embarassed himself in court? The twins and my nephew were taken away from us and placed with their biological father and his meth addicted girl friend in a home that Officer Decker said was being watched for drug activity. Karen Hansen is well known for her multiple court appearances in the last decade for meth related crimes as well as chronic shoplifting. My sister molested a four year old child in Portland and CSD terminated their involvement with the children two months after the court case saying they were now 13 and 14 years old, old enough to run away if they felt they were in any danger and placed them in the custody of their father. Two weeks later he and his girlfriend put the two girls, thirteen, out of their home telling them they were to never look at them again, they don’t have a father or a brother. If they called their father they would have harassment charges brought against them. They came to our home.
So, you can see if I have a hard time believing that this man, Josh Marquis, gives a damn about women, children or drug or substance problems in any real sense of the word. I saw some nice, well dressed people take the mike at the meeting saying they were victims of such and such and Josh held their hands and called them a few weeks later to make sure they were okay and I have a hard time believing it as reality. Maybe thats the treatment you get if your in Josh’s tax bracket. Maybe its what you get if your dressed right or call him by his first name. Its not the treatment you get if your religion is different than his or if you have fifty people begging for him to or his office to take a serious look at a matter.
I’ve known of at least four other cases which people have had friends write to the District Attorney regarding cases and the response has always been the same, the DA has treated the letters with disdain and contempt yet he has the nerve to ask people to write on his behalf!
The twins remained with us. They graduated University of Oregon with bachelors before they turned 21. One of went on to graduate Lewis and Clark University with a Master’s in education before they were 22, the other traveled Asia and India, serving in an Institution teaching women from the Untouchable caste how to start cottage industries to raise the economy of their villages. They sent announcements to Marquis and Nelson when they graduated a few years ago. Nelson, who has never talked to them since the trial, sent them cards with beautiful messages. Marquis sent them … nothing.
Excuse me if I haven’t seen any evidence that he cares.

Name one person in this county who has ever been prosecuted or persecuted because of my personal dislike or animus towards them. Certainly Carrie is not afraid to speak up loudly and often.
Or ask the Commissioners to see the letters they have received about this controversy (they are all public record). Exactly one supported the Budget Committee. The other 11 supported reinstating the supplement.
All three members of the Clatsop legislative delegation (Reps. Witt and Boone and Sen. Johnson) wrote letters urging the commission to reconsider taking away my supplement.
I asked people to show up and people did. Their presence is a credit to the fine work done by the people who work in my office. Now it’s up the Commission to decide what to do at their June 27 meeting.

No, its not just up to the Commission to decide what to do at their June 27th meeting. Its up to YOU to follow through and work with them for the next couple of weeks until that meeting as you indicated you would do today in front of all of those people who spoke up for you. Patch things up and reunify the county. That’s within your power. Or was that, too, granstanding? Or am I wrong about that? You didn’t say you were willing to work with the county on your budget and goal setting? Or are long posts and op-eds that you didn’t write too hard for you to understand? Law school was a long time ago for you and you are more content and used to just reading yourself.
Or don’t work with them, please, by all means, walk away. I am pretty confidant 20,000 people will gladly take their chances that Jean Dominey’s mafia bosses will materialize about as quickly as her neighborhood gangs did after Geno’s started serving beer.
When Betsy Johnson wrote to you regarding a teenager who was having intense problems in her home you said it wasn’t the place of a representative to tell a state Children’s Service Office how to investigate its cases. Its amazing now, how it is a state senator’s place to tell county commissioners how to spend our money. WOW! You mean our state legislators want the county to make up the state’s deficit and they won’t have to deal with the problem? Imagine that!

Who is Lori? Who paid her and on what time and with what resources did she use in compiling, printing, and copying the handouts you had her distribute to the commissioners to make your point to give you back your personal bonus. The bonus you don’t need but are going after as a matter of principle.
